Introduction.
Welcome to the ThinkPets Web site (www.thinkpets.com) operated by ThinkPets, Inc. (“ThinkPets,” “we,” “us,” or “our”). ThinkPets respects each individual’s right to personal privacy. ThinkPets collects practice, client and patient data from practice management systems and through our Web site to provide valuable client communications services, data analysis and consulting services. We will collect and use information through our Web site only in the ways disclosed in this privacy policy statement (our “Privacy Policy”). This Privacy Policy applies solely to information collected at the ThinkPets Web site and your use of the ThinkPets services.
Part I. Information Collection.
Whether you are a veterinarian, a veterinary technician or a valued staff member in a veterinary hospital, we understand that you must be confident that all information you disclose to us is treated professionally and confidentially. We believe that having a relationship with our users that is founded on trust is not only good manners it is also good business. Any feedback you'd like to provide to help us better meet your expectations in this arena is welcomed. The following sections describe what type of information we collect, when we collect it and how we use it.
Registration Information.
In order to use the ThinkPet services available on our Web site, you must be a registered user of a clinic or veterinary hospital who has subscribed for our services. We ask our registered clinics and individual users to provide their name, address, email address, telephone number, fax number and information regarding their affiliated practice, as applicable, when they register. Registered users can verify and update their account information at any time by logging in to their account on the Web site and using the link to Account Settings on the main page. Disclosure of a users’ name, contact information and clinic information is mandatory. Other information we request is optional and users may choose whether or not to provide it to us.
We may also from time to time ask you to provide other personal information through your account, including your email address, website, patient logo, client codes, staff photos. This information will be used only to provide aggregate demographic information to our advertising partners. We will only use such information in the aggregate and we will not connect such information to personally identifiable information, such as people’s names or email addresses.
Additionally, in order to purchase our services through the Web site you will also be required to submit your payment information including credit card number, billing name and address and expiration date.
Your Client Information.
Through the Web site you may upload and/or otherwise provide and edit the names, contact information and pet information of your clients. You may provide and/or edit the following information about your clients: name, address, email, pet’s name, pet’s species, pet’s breed, pet’s birthday and treatment information.
Contact Us.
We provide customer service support and the opportunity to provide feedback through our Web site via a contact form available on the Web site. In order to contact us via the form, we will ask for your name and email address. We also provide you with a field to describe your request or submit your comments. We only use information received from customer support requests, including email addresses, for customer support services. Any other information you provide will be used for purposes of monitoring or improving the use and satisfaction of our services.
Site Usage Statistics and Cookies.
We collect site usage statistics from clickstream tracking and automatic logging files. We also employ cookies. A cookie is a small text file that our Web server places on a user’s computer hard drive to be a unique identifier. Cookies enable us to track usage patterns and deliver customized content to users. By setting a cookie on our Web site users would not, for instance, have to log in a password more than once, thereby saving time while on the site. Users may elect to reject our cookie however certain functions and conveniences of the Web site may not work properly with cookies disabled. Our cookies don’t have an expiration date. Our cookies don’t collect personally identifiable information, but they do identify the visitor as someone who is registered with our Web site.
Part II. Information Usage; Sharing with Third Parties.
Use by ThinkPets.
The information collected by ThinkPets will be used to assist in managing your client information and to provide the various ThinkPets services you may subscribe for or request, such as delivering email newsletters, reminders and/or direct mailing campaigns. We use this information to produce and deliver targeted client communications on behalf of the practice, track and predict client behaviors, analyze rate of consumption of services and products by clients and pets and measure practice performance and compare to other practices. We also collect general data that is not personally identifiable information via poll results, site usage and visitor’s host domain name information. We use this information to provide additional relevant content to our users and to improve upon the services offered on the Web site as described above.
Credit card numbers are used only for payment processing and fraud protection, and while they are stored by us and on the Web site for future use, they are not retained for any other purposes.
Registered users may also receive email newsletters containing ThinkPets content from us. Registered users may receive additional announcements from us about products, services, and special announcements. Out of respect for the privacy of our users we present the option to not receive these types of communications. In order to opt out of receiving these communications, users should follow the ‘unsubscribe’ instructions contained in any communication they receive.
The information we collect will not be used to create customer profiles based on browsing. We will not supplement information collected at our Web site with data from other sources except as we may receive from the various users connected to the same veterinary practice or as we receive from your clients who use our related ThinkPets services, such as our HealthyPetU.com Web site.
Sharing Information with Third Parties.
We may use, analyze and/or aggregate you and your clients’ data and information as well as analyze and aggregate it with similar data received from other veterinary practices maintained by ThinkPets. We will not connect such information to personally identifiable information, such as client, pet or practice name. We may share this aggregated data with suppliers of advertisements, potential affiliate partners in academia and industry, as well as other commercial relationships or other purposes.
In addition, we will share the personal information we collect from you under the following circumstances:
  • Protection of rights. We will share personal information if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is appropriate to enforce the Terms of Service for the ThinkPets Web site, or, if you are a party thereto, our Veterinary Terms and Conditions, including any investigation of potential violations thereof, (iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the ThinkPets Web site or services, or (iv) such action is appropriate to protect the rights, property or safety of ThinkPets, its employees, users of the ThinkPets Web site or others.
  • Asset transfers. If we become involved in a merger, acquisition or other transaction involving the sale of some or all of ThinkPets’ assets, user information, including personal information collected from you through your use of the ThinkPets Web site or services, could be included in the transferred assets. Should such an event occur, we will use reasonable means to notify you, either through email and/or a prominent notice on the Web site.
  • Service Providers. We may share your personal information with service providers that we engage for the purpose of processing information on our and your behalf. For example, we may partner with other companies to administer postage and mailing services in order to deliver reminders and newsletters to your clients. Additionally, we may partner with other companies to process consumer surveys, or to process, analyze, and/or store data. While providing services for us, these companies may access your personal information. To the extent applicable, we require these entities to comply with this Privacy Policy and appropriate confidentiality and security measures.
Part III. Links to Third Party Websites.
We offer links to other Web sites. Please be aware that we are not responsible for the privacy practices of such other sites. When you click on links to other Web sites, we encourage you to read their privacy policies. Their standards may differ from ours. This Privacy Policy applies solely to information collected by this Web site.
Part IV. Policy Modification.
We may change this Privacy Policy from time to time. All users and visitors will be bound by any changes to our Privacy Policy when you use the Web site after such changes to our Privacy Policy have been posted.
Part V. Changing Your Information.
ThinkPets maintains the accuracy of our information by allowing registered users to login in to the Web site and update their name, email, user name, password and other information using the Account Settings and Billing Details pages. Users may access their own and their client’s personal information that is available on our Web site and update it or contact us by email about inaccuracies they may find. Users may request by email that ThinkPets terminate their account and inactivate the use of their information from use for future communications.
Part VI. Minors.
ThinkPets does not actively market to children, and we never knowingly ask a child under 13 to divulge personal information. Our Web site and services are intended for use by adults over the age of 18 only. By using our Web site and services, you represent that you are 18 years of age or older. We will not knowingly collect personally identifiable from minors under 18 years of age, and if we learn that we have inadvertently collected such information, we will promptly delete it.
Part VII. Data Storage and Security.
ThinkPets protects user information with the following security measures: secure servers (which may be operated by third parties contracted for such services by ThinkPets), firewalls, and SSL encryption. Due to the nature of the Internet, we cannot guarantee that communications between you and ThinkPets, and other users and you, will be free from unauthorized access by third parties or accidental loss or damage. Therefore, your use of the Web site and the services, and your disclosure to us of any personally identifiable information, is at your own risk. However, once we receive a transmission from you, we make reasonable efforts to ensure the security of your information in our operations.
If we learn of a security breach through which sensitive personal information may have been compromised, we may attempt to notify you electronically so that you can take appropriate protective steps. We may post a notice on our Web site if a security breach occurs. By using this Web site, or providing personal information to us through any means, you expressly agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of this Web site and our services.
